Talesake Terms of Service

Talesake LLC | Effective October 23, 2026

Our promise to you

What we promise. You own it. Your original recordings stay yours, at full quality, and you can download everything anytime. Your stories are kept safe in your Talesake account, encrypted in transit and at rest. We never sell your family's stories or use them to train AI, and nobody at Talesake watches your family's videos unless your family asks us to or the law requires it (Section 6).

What our AI providers do today. The AI services we pay for never train on or sell your answers. They only hear the audio of an answer, the names of the people in it, any question you type into the help chat, and, if you choose the voice guide during setup, your spoken answers to the setup questions (like names and what your family calls each other). Never your video, and they keep it only briefly for safety checks before deleting it.

If anything changes. If any of our AI providers plans to change how it handles your data, we'll tell you before the change happens.

Talesake never sells your family's stories or data. We never mine them. We never use them to train AI.

These Terms explain how Talesake works and what we expect from each other. We wrote them in plain English. Please read them. If something is unclear, write to us at [email protected].

The short version

1. Agreeing to these Terms

Talesake LLC is a Nevada limited liability company based in Henderson, Nevada ("Talesake," "we," "us"). These Terms are an agreement between you and Talesake. They cover the Talesake app (the web app and installable app at app.talesake.com, on phones and tablets), and our related services (together, the "Service").

By creating an account, accepting a Family Pass, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use Talesake

Younger family members may appear in recordings or watch stories alongside a parent or guardian who holds a Family Pass. See "Children" in our Privacy Policy.

3. Family accounts

The Family Keeper

Each family account has a Family Keeper. The Keeper owns the account and the stories in it. The Keeper chooses who can watch, approves join requests, manages billing, and can remove access at any time.

A second Keeper

We strongly encourage every family to name a second Keeper. A second Keeper can help with backups and can keep the account running if the main Keeper is unable to for a while.

Family Passes

A Family Pass gives a family member view-only access to the family's stories. Every paid plan includes unlimited Family Passes, so any number of family members can watch. Regular includes 2 storytellers; Premium includes unlimited storytellers. A storyteller is anyone who records, on the Keeper's device or their own phone. A Family Pass holder cannot edit, delete, or download stories unless the Keeper allows it.

Invitations and join requests

The Keeper can invite family members by text message. Family members can also ask to join, and the Keeper decides whether to approve. When you send an invitation by text, you confirm that you know the person and that they would expect to hear from you. Talesake sends invitations only when you ask us to.

When the Keeper removes a Family Pass, that person loses access. Anything they have already watched or saved outside Talesake is outside our control.

4. Consent to be recorded

Talesake is about real people sharing their real stories. That only works with consent.

Some Storytellers may need help giving consent, for example because of memory changes. In that case, a family member or a person with legal authority (such as an agent under a power of attorney or a guardian) may need to co-sign consent along with the Storyteller. We will ask for this when it applies.

You promise that you have every consent needed for what you record and share. Recording laws differ from state to state. You are responsible for following the law where you record.

5. Your stories belong to you

You (through the Keeper) keep all ownership of your recordings, photos, recipes, diary entries, and anything else you add ("Your Content"). We do not claim any ownership of it.

You give Talesake only the limited permission needed to run the Service for you. That means storing Your Content in your Talesake account and keeping a protected recovery copy of your family's key so we can help you restore it, sending the audio of an answer, the names of the people in it, any question you type into the help chat, and, if you choose the voice guide during setup, your spoken answers to the setup questions to our AI providers as described in Section 7, and delivering Your Content to the people you choose. This permission ends when Your Content is deleted, except for short backup and legal holds described in our Privacy Policy.

What we never do with Your Content: sell it, rent it, mine it for advertising, or use it to train any AI model. We will not let our providers do those things either.

You can download everything, at full original quality, anytime, using Download all.

6. How your stories are stored

Every story you record uploads automatically to your family's Talesake account. That account copy (your cloud copy) is the main copy. Stories stream from your account. Your device keeps only a small cache so stories play quickly, and it clears that cache on its own to save space. Downloading stories to your device is optional. You can export everything anytime with Download all. Losing your Keeper code (spare key) or recovery card does not mean losing your stories.

Your stories are encrypted in transit (while they travel to us) and at rest (while we store them). This is standard encryption, not end-to-end encryption: Talesake keeps a protected recovery copy of your family's key, so we can help you restore your stories if you lose your devices, spare key, or recovery card.

Nobody at Talesake watches your family's videos unless your family asks us to (for example, for support) or the law requires it, for example to act on a child-safety report (Section 12). Investors never have access to your stories.

Greetings are private by default: only Keepers see them unless you choose to share them. They are backed up to your account like every other story.

You can download everything, at full original quality, anytime, using Download all.

To help keep your stories safe:

We work hard to protect your stories, but no system is perfect. Our responsibility for lost data is limited as described in Section 14.

7. The AI host

Talesake offers an optional AI host that asks follow-up questions and keeps the conversation going. It is off unless your family chooses it: the Family Keeper can turn it on or off in Settings. When it is on, here is exactly how it works:

  1. Your phone or tablet records the video and audio and uploads it to your Talesake account.
  2. The device decides when the Storyteller has finished an answer.
  3. Only the audio of that answer is sent, through our server, to Google's Gemini service on Google's paid API tier. With it we send a short text note so the host can ask a good next question and say names correctly: the name the Storyteller goes by, the names of family members already saved in your account with their relationship and what they call the Storyteller, the chapter title, the question just asked, and the other questions in that chapter.
  4. Gemini listens to the answer and writes one short follow-up question, and lists the people mentioned in that answer so the app can add them to your family's list of people (which you can edit). A Gemini voice (never the Storyteller's voice) then speaks that question.
  5. Talesake does not keep a transcript of the answer. We do not store the audio we sent, the note, or the question on our servers; our logs keep only counts, timings and error codes.
  6. Your video is never sent to the AI host.

In short: The AI services we pay for never train on or sell your answers. They only hear the audio of an answer, the names of the people in it, any question you type into the help chat, and, if you choose the voice guide during setup, your spoken answers to the setup questions (like names and what your family calls each other). Never your video, and they keep it only briefly for safety checks before deleting it. The help chat works the same way: only the question you type is sent.

Under Google's terms for its paid tier, Google does not use this content to improve its products. Google may keep it for a short time to watch for abuse, as its terms allow. If any of our AI providers plans to change how it handles your data, we will tell you before the change happens.

Real and AI labels

Real recordings are labeled Real. Anything the AI produces, such as the host's questions, is labeled AI. AI can make mistakes. The real recording is always the true version.

8. Future AI voice features

We may one day offer a feature that uses a Storyteller's own voice with AI. If we do:

9. Plans, prices, and billing

Plans

PlanPriceWhat you get
Free$0Setup and the first chapter, backed up to the cloud automatically. After that, new recordings need a paid plan. You can always watch and export what you have recorded.
Regular$99 per year
Or pay monthly instead: $9.99 per month
The full app, 2 storytellers, unlimited family viewers (Family Passes) and 50 GB of cloud storage.
Premium$149 per year
Or pay monthly instead: $14.99 per month
Everything in Regular, including unlimited family viewers, plus unlimited storytellers, 100 GB of cloud storage and cold storage.
Extra storage$3 per month or $30 per year for each 100 GB block, billed on the same charge as your planRegular: needed to keep uploading past the included 50 GB (or upgrade to Premium). Premium: needed past 100 GB. Not part of Premium.

Cloud storage limits

Every paid plan includes 50 GB of cloud storage for your family's stories. Regular: there is no cold storage. When the cloud copy reaches 50 GB, new uploads need either an upgrade to Premium or an extra storage add-on: 100 GB blocks at $3 per month or $30 per year, billed on the same charge as your plan. Premium: cold storage is a Premium feature. When the cloud copy reaches 50 GB, older videos move to lower-cost cold storage; they stay in your cloud copy, and you can still watch and download them. Past 100 GB, Premium also needs extra storage add-on blocks. Extra storage is sold separately and is not part of Premium. If you leave Premium: if your cloud copy is over 50 GB when you move from Premium to Regular, nothing is deleted; new uploads pause until you add storage (or return to Premium).

If an extra storage add-on lapses while your plan is active, new uploads pause until you renew it or make room. Nothing already stored is deleted. What happens to the cloud copy after you cancel your plan is explained in Section 10.

Prices are in US dollars and do not include taxes, which are calculated and collected at checkout where required.

Automatic renewal

Your plan renews automatically until you cancel.

Price changes

If we change a price, we will tell you at least 30 days before it applies to you. The new price starts at your next renewal. You can cancel before then.

Refunds

If you ask within 14 days of a charge for a family plan, you can get that charge refunded in full. This covers your first purchase and every renewal of a family plan. Gift purchases are different: see Gift and tester codes below. To ask for a refund, email [email protected].

You can cancel anytime with Manage billing. Your plan stays active until the end of the period you already paid for.

Payments

Purchases on our website are sold and processed through Stripe Managed Payments. For these purchases, Stripe acts as the seller (merchant of record) and handles sales tax, and its own terms also apply to the purchase. If we later offer Talesake through the Apple App Store or Google Play, purchases made there follow those stores' billing, cancellation, and refund rules.

Gift and tester codes

A gift or tester code gives one family the plan shown on it for one year, starting the day the code is redeemed. Each code can be used once, has no cash value, and cannot be resold. Tester codes are given free to friends, family and early testers. When the year ends, the family can choose a paid plan or stay on the free plan; your stories stay yours, and Download all keeps working. Gifts are open: you can buy one year of Regular ($99) or Premium ($149) as a gift, paid once. Gift codes never expire, to the fullest extent the law allows: the year starts when the code is redeemed, whenever that is. Gift purchases are final. There are no refunds for unused or unopened gifts, except where the law requires otherwise.

10. Cancelling

You can cancel a paid plan anytime. Your plan stays active until the end of the period you already paid for. After that:

11. Using Talesake kindly and lawfully

Talesake is a place for families. Please do not:

If you break these rules, we may limit, suspend, or close your account. Where we can, we will tell you first and give you a chance to download your stories.

12. Reports, child safety, and legal requests

Reporting a concern

If you see something on Talesake that worries you, write to [email protected]. We will look into it.

Child safety

If we learn of apparent child sexual abuse material on our systems, we will report it to the National Center for Missing & Exploited Children (NCMEC) as the law requires, and we may preserve information and close the account.

Requests from government and courts

We only give information to law enforcement or others when the law requires it, such as with a valid subpoena, court order, or warrant. We can only provide what we hold. Because Talesake can restore stored stories, this can include your stories, as well as the account information described in our Privacy Policy. Unless the law or a court forbids it, we will tell you before we share.

13. Other services we use

Talesake relies on trusted providers, including Cloudflare (hosting and storage), Google (the AI host), and Stripe (payments; for website purchases Stripe is the seller of record). Later we may also use the Apple App Store and Google Play. Each has its own terms. We choose providers that respect our promise, and we explain each in our Privacy Policy.

14. Disclaimers and limits on our responsibility

We work hard to make Talesake reliable, but we cannot promise it will always be available, error free, or that data will never be lost. Except as stated in these Terms or required by law, the Service is provided "as is" and "as available," without other warranties.

To the extent the law allows:

Some states do not allow some of these limits, so they may not all apply to you. Nothing in these Terms limits rights you have that cannot be waived by law.

15. If a claim is brought against us

If someone brings a claim against Talesake because of content you recorded or shared without the right consent, or because you broke these Terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.

16. Changes and ending the Service

We may improve or change the Service over time. If we make a change that takes away a major feature you pay for, we will tell you ahead of time.

If Talesake ever shuts down or stops offering the Service, we will email you at least 90 days before. You will get a one-click export of every story as plain MP4 video files that play anywhere, and your stories will stay downloadable through the whole notice period. This matches our public promise at talesake.com/promise. Your stories will remain yours.

You can close your account anytime. We may close accounts that break these Terms, as described in Section 11.

17. Resolving disagreements

If you have a problem, please write to us first at [email protected]. Most issues can be solved quickly and kindly.

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules.

If you have a problem with Talesake, contact us at [email protected] and we'll work to resolve it.

18. Changes to these Terms

We may update these Terms. If a change is important, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using Talesake after that, the new Terms apply. If you do not agree, you can cancel and download your stories.
